Professional bio
Matt has 30 years’ experience as a personal injury specialist. His workload predominantly concentrates on document heavy employer liability and public liability cases with an emphasis on defending dishonest claims. His lay clients include large retailers, factories, logistics companies and farming concerns.
He has made significant savings for his clients and achieved numerous findings of fundamental dishonesty at all levels of claims. In many cases claimants have withdrawn their claims part-way through trial on terms as to costs.
At trial, the court frequently comments on the detailed, forensic and robust nature of his cross-examination:
“In relation to cross-examination by Mr Cottrell, this was performed professionally, proportionately and reasonably and given the nature of the questions, he left the claimant with nowhere to go but to admit factors were misleading.”
In relation to RTA litigation, again with an emphasis on defending dishonest claims, he has enjoyed considerable success including findings of fundamental dishonestly in 3 “test cases” which resulted in the withdrawal of the 54 remaining claims brought by passengers of a bus. Additionally, he is regularly instructed in relation to the defence of credit hire claims.
He has successfully appeared in numerous appeals in the High Court and Divisional Court as well as at Circuit judge level.
His paperwork practice, aside from advising on prosects, tactics and quantum, is primarily concerned with the questioning of experts under part 35 where he frequently gains considerable ground for his clients on issues of causation and credibility.
